MINNEAPOLIS – A Minnesota federal judge on March 8 ruled that issues of fact preclude summary judgment over whether a claimant’s neck and back pain arise from an “accidental injury” or a sickness under an individual disability income policy (Allen I. Javinsky v. Hartford Life Insurance Co., No. 09-888, D. Minn.; 2010 U.S. Dist. LEXIS 20842).
